Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs the use of internet-related services provided by Rapid Fiber Internet, LLC (“Rapid Fiber”).

In this AUP, “Service(s)” refers to any Internet-related service the Customer receives from Rapid Fiber, including, but not limited to, high-speed internet access, managed WiFi, VoIP (if elected), and dedicated internet access (for business Customers only). By using any Rapid Fiber Service and/or accepting this AUP, the Customer agrees to abide by and be bound by the provisions of this AUP.

Prohibited Uses and Activities
Rapid Fiber’s Services may only be used for lawful purposes and in accordance with this AUP and Rapid Fiber’s Terms and Conditions. The below prohibited uses and activities have been established by Rapid Fiber for a variety of purposes: to comply with applicable law; to ensure reliable and enjoyable service for all of Rapid Fiber Customers and users; to ensure security and privacy of Rapid Fiber’s network and systems; to maintain Rapid Fiber’s reputation as law-abiding, honorable, and customer-friendly; and to preserve the privacy and security of each user’s personal information at all times. Accordingly, every Customer and user of Rapid Fiber Services warrants that the Services will not be used:

  • In any manner that violates any federal, state, international, or local law or regulation;
  • In a manner that materially interferes with Rapid Fiber’s activities or overall business or harms any of Rapid Fiber’s Customers, employees, affiliates, agents, officers, or directors;
  • To threaten, bypass, or destroy any security mechanism used with or incorporated in the Service or Platforms;
  • To disparage, denigrate, insult, or otherwise make pejorative statements about Rapid Fiber and/or any of its affiliates, directors, officers, employees, partners, brand, products, or services;
  • To transmit any content or information that is offensive, lewd, pornographic, defamatory, libelous, harassing, tortious, abusive, illegal, prejudicial, discriminatory, or otherwise inappropriate or objectionable;
  • To transmit any marketing, advertising, or promotional materials, including without limitation any “spam,” “junk mail,” or other deceptive or unsolicited bulk or commercial email;
  • To harm, or attempt to harm, minors in any way;
  • To resell or otherwise make available the Services to third parties (for example, through Wi-Fi or other methods of networking), in whole or in part, directly or indirectly, unless expressly permitted by a separate business services agreement (this excludes a residential customer’s family and household guests and a business customer’s authorized employees and guests);
  • To impersonate Rapid Fiber (including any officer or employee), any user of Rapid Fiber’s Services or Platforms, or any other person or entity;
  • To transmit any content, data, or material that infringes the intellectual property rights or other personal rights (including privacy) of any third parties;
  • To use the Services or Platforms in connection with unsolicited, unwanted, or harassing communications, including without limitation, SMS messages, phone calls, voice mail, chat, video, or email;
  • To transmit any content, data, or material that contains viruses, spyware, spiders, robots, worms, Trojan horses, logic bombs, or any other type of malicious or deleterious programs;
  • To use the Services or Platforms to collect information about other users, including phone numbers or email addresses, without such individual’s prior explicit consent or otherwise under false pretenses of any kind;
  • In any manner that violates any other applicable policy maintained by Rapid Fiber, including without limitation the Privacy Policy, Service Agreement, and Copyright Policy;
  • In any manner that can reasonably be considered contrary to Rapid Fiber’s goodwill, public image, and overall reputation;
  • To express or imply that any user’s statements, activities, or causes are endorsed by Rapid Fiber;
  • To collect, or attempt to collect, personal information about users or other third parties without their prior knowledge and affirmative consent;
  • To divulge any of Rapid Fiber’s (or any affiliate’s) proprietary information;
  • In any manner that promotes any illegal activity (such as driving under the influence, illegal drug use, violence, child abuse, or underage drinking); or
  • To knowingly receive, use, re-use, upload, or download any material that:
    • Contains material that may reasonably be considered obscene, defamatory, offensive, abusive, hateful, inflammatory, harassing, violent, or otherwise objectionable;
    • Promotes pornographic or other sexually explicit material, discrimination, or violence, based on race, religion, nationality, sex, gender, disability, age, or sexual orientation;
    • Is likely to deceive any person acting reasonably under the circumstances;
    • Impersonates any person; or
    • Involves commercial activities or sales unless otherwise identified as a Rapid Fiber Business Customer

Monitoring Use
Rapid Fiber regularly monitors the use of Rapid Fiber’s Services and Platforms to confirm compliance with the terms of this AUP and any other applicable policy. Rapid Fiber maintains the right to monitor, at any time, all such usage by any means Rapid Fiber, in its sole discretion, deems appropriate and delete any material deemed illegal, inappropriate, or violative of any Rapid Fiber or applicable third-party policy.

The customer hereby waives and holds harmless rapid fiber, along with rapid fiber employees, officers, directors, affiliates, licensees, and service providers, from any and all claims resulting from, or arising directly or indirectly out of, any action taken by any of the foregoing parties in connection with investigations by either rapid fiber or law enforcement authorities.

Violation of this AUP
Any violation of this AUP may result in Rapid Fiber taking whatever action it deems reasonably necessary or appropriate to address the behavior. The following is a non-exhaustive list of potential actions:

  • Issue written or verbal warnings;
  • Disclose a Customer’s or User’s personal information to a third party claiming that the Customer or User violated his or her rights (such as his or her intellectual property or privacy rights);
  • Suspend a Customer’s account and/or Services;
  • Terminate a Customer’s account and/or Services;
  • Bill a Customer for administrative costs and/or reactivation charges; and/or
  • Take legal action (e.g., making a referral to law enforcement, enjoining violations, and/or collecting damages, if any, caused by violations).

Rapid Fiber may but is under no obligation to: (i) provide the Customer with advance notice of an AUP violation, via e-mail or otherwise; and (ii) request that such violation be immediately corrected prior to taking appropriate action. Rapid Fiber reserves the right to act immediately and without notice to suspend or terminate Services in response to a court order or other legal requirement that certain conduct must be stopped or when Rapid Fiber determines, in its sole discretion, that the conduct may:

  • Expose Rapid Fiber to sanctions, prosecution, or civil action;
  • Cause harm to or interfere with the integrity or normal operations of Rapid Fiber’s networks or facilities;
  • Interfere with another person’s use of Rapid Fiber’s Services or the internet;
  • Damage or disparage the reputation of Rapid Fiber or its Services; or
  • Otherwise present a risk of harm to Rapid Fiber or its Customers or their employees, officers, directors, agents, or other representatives.

Rapid Fiber (i) may refer potential violations of laws to the proper authorities, (ii) may cooperate in the investigation of any suspected criminal or civil wrong, and (iii) will cooperate with authorities when required to do so by law, subpoena, or when the public safety is at stake. Rapid Fiber assumes no obligation to inform the Customer that his, her, or its information has been provided to law enforcement authorities and, in some cases, may be prohibited by law from providing such notice. Rapid Fiber will not be liable for any damages of any nature suffered by any Customer, user, or third party resulting in whole or in part from Rapid Fiber’s exercise of its rights under this AUP.

Account Security
Each Customer is responsible for any misuse of his or her account, even if the inappropriate activity was actually committed by someone other than the account holder (e.g., his or her family member or friend). Therefore, each Customer must take all reasonable steps to protect his or her account from unauthorized access. In addition, no Customer may access his or her account to breach the security of any other Customer’s account or attempt to gain unauthorized access to another server or network. As such, each Customer must ensure the security of his or her password at all times, including without limitation, by not sharing it with others for any reason.

Reporting Violators
Rapid Fiber depends on its Customers to help keep the network safe. Accordingly, please report suspected AUP violations or violations of any other Rapid Fiber policy to Rapid Fiber promptly. Such report shall be sent to and include:

  • Name of alleged violator(s);
  • Date and time (including time zone) of the alleged violation(s);
    The IP address(es) used to commit the alleged violation(s), if available;
  • Description of alleged violation(s);
  • Evidence of the alleged violation(s) (including screenshots and videos); and
  • The reporter’s involvement, if any, in the violation (and how the violation was discovered in the first instance).

Rapid Fiber will treat and maintain the identity of those who report known or suspected violations with the utmost secrecy at all times.

Modifications and Updates to this AUP

Rapid Fiber reserves the right to modify and update this AUP at any time in its sole discretion. Notification will be provided (1) by posting the update version on Rapid Fiber’s website (the date under the title of the Policy will be updated, and the word “Revised” will precede the date); and (2), via the email address associated with the Customer’s Rapid Fiber account.
